Nothing is sold on this site: you ask, we weigh it at the counter, and you pay there.
These are the terms for using the Eastern Market Provisions catalogue and for a farm produce pickup in Detroit arranged through it. They cover what the price on a page means, how long a set-aside order waits, and what happens if a tomato is soft when you open the bag. Each section opens with the one thing it decides.

When these terms apply
These terms run from September 29, 2026.
This version took effect on September 29, 2026 and was last updated the same day. It applies to every visit and every pickup request made from that date. A request sent before it stays under the version that was posted when you sent it.
01 · PARTIES
Who you are dealing with
Your agreement is with Easternmarket, a counter shop in Detroit, Michigan.
The site and the shop are run by Easternmarket, trading at easternmarket.us under the name Eastern Market Provisions. The counter is at 2934 RUSSELL STREET, DETROIT, MI 48207, United States. Phone (313) 833-9300. Email [email protected].
We are a small shop. When you call, you reach someone who handles the stock, not a call center.
02 · SCOPE
What the site does and does not do
The site shows what is in and lets you ask for it; it does not ship, book slots or take money.
The catalogue lists seasonal vegetables and fruit, sourdough bread, raw Michigan honey, small batch preserves, pastured eggs and a few dry staples, each with its county, its unit and its harvest or bake window. You can send a pickup request through the request form, use the chat, or call.
We do not ship perishables. Not eggs, not bread, not a single tomato. Every order is collected at 2934 Russell Street. There are no accounts, no passwords and no delivery service. Stock on the site reflects what we expect that week; a late frost or a wet harvest can empty a line before the page is updated, and we will tell you on the call.
03 · ORDERS
How a request becomes an order
A request is a question until a person from the counter confirms it with you by phone or email.
Nothing is sold or paid for on this site. There is no cart and no checkout, and we never ask for card details online. Any figure you see on a page is an estimate of the week's board price, not a binding quote.
- You send a request: the item, the amount (six eggs, one loaf, a half-bushel) and a phone number.
- We call or email back to confirm what we have, the approximate weight and the pickup day.
- Once you agree on that call, the order exists. We set it aside with your name on it.
- At the counter we weigh or count it, tell you the total, and you pay there.
If we cannot reach you, nothing is set aside. We try twice before we let a request go.
04 · PRICE
What a price is based on
Prices are in US dollars, set per unit for the week, and the final figure is the weight on our scale.
Every item is priced on a stated basis: per lb for heirloom tomatoes, apples and root vegetables; per bunch for greens; per loaf of about 900 g for sourdough; per 1 lb jar of honey or 8 oz jar of preserves; per dozen or half-dozen for eggs; per lb bag for dry staples. All prices are in USD.
The price on the board is the week's price. It moves with what farms charge us, and a tomato in late September costs something different from one in early August. The half-bushel for canning tomatoes is about 25 lb and the Michigan apple half-bushel about 21 lb. We say "about" because we fill by volume and weigh after; you pay for the weight on the scale, not the round number.
Half-bushel orders are placed two days ahead. The price confirmed on the call holds for that pickup day.
05 · PICKUP
How long we hold your order
We hold a confirmed order until the end of the agreed pickup day and not past it.
Produce is put aside with your name on it for the day we agreed. Eggs stay in our cooler at 40°F until you arrive. Sourdough is baked the night before, so it is meant to go the same day. If the day passes, the stock goes back on the counter and gets sold to someone else. That is not a penalty; it is the only way to keep a tomato from sitting a week in a bag.
Need to move the day? Call before it. We will move it if the stock will still be good; for bread and ripe tomatoes that is usually not possible.
06 · GUARANTEE
The freshness replacement
If something is spoiled when you pick it up and you tell us at the counter, we replace it.
Open the bag at the counter if you want to. If a tomato is split and leaking, an egg is cracked, a bunch of chard has gone slimy, or a loaf is not that day's bake, show us. We replace that item from the same stock. If we have none left, we take it off your bill.
The replacement covers spoilage present at pickup and reported before you leave. It does not cover produce that ripens or softens in your kitchen days later, since that is what heirloom tomatoes do, or cosmetic marks like a russet patch on a Northern Spy. It is a replacement, not a cash refund on top of it.

07 · USE
What you may not do here
Use the site to ask about food, and nothing that harms the site or the people answering it.
Do not send false requests, requests in someone else's name, or bulk automated submissions. Do not scrape the catalogue, probe the server, try to reach areas not linked from the public pages, or send malware through the form or chat. Do not use the chat to harass the person answering it. We delete abusive messages and block the sender.
08 · OWNERSHIP
Who owns the words and pictures
The text, photographs, logo and name belong to Easternmarket or are used under license.
You may read, print and share links to these pages for personal use. You may not copy the photographs or catalogue text onto another site, use the Eastern Market Provisions name or logo to sell anything, or suggest that we endorse you. Farm and variety names such as Brandywine or Northern Spy belong to nobody here; they are what the fruit is called.
09 · AS IS
What we do not promise
The site is provided as it is, and seasonal information on it can be out of date.
Harvest windows, varieties and counties are what the farms tell us and what we expect. They are not warranted. We do not promise the site is free of errors or always available. Nothing on it is dietary or medical advice. Raw honey is not for infants under one year old, and if you have an allergy, ask us on the call what else the bakery or kitchen handles; we will tell you what we know and say so when we do not.
10 · LIMIT
How far our liability goes
Our liability for an order is limited to what you paid for it at the counter.
To the extent Michigan law allows, we are not liable for indirect or consequential loss, such as a canning session that did not happen, and our total liability for any order is the amount you paid for it. Using the website alone, without an order, creates no payment and so no liability for loss. Nothing here limits liability that the law does not allow us to limit, including for death or injury caused by negligence.
11 · ACCESS
When we can refuse a request or block access
We can decline a request or cut off access for anyone who breaks section 07.
We may decline any request, for example an order we cannot fill, or a half-bushel from someone who has already missed three agreed pickups. We may block an address or chat session that abuses the form. We can also take the site down for maintenance or close it. Orders already confirmed by phone are still honored at the counter.
12 · LAW
Which law applies
These terms run under the law of Michigan, United States, and disputes go to the courts of Detroit.
Before anything goes near a court, call us. Most problems with a bag of apples are settled at the counter in two minutes. If one is not, the law of the State of Michigan governs these terms and the courts of Detroit hear the dispute. Consumer rights that your own state's law gives you and that cannot be waived still apply.
13 · CHANGES
How changes are announced
A change is posted on this page with a new date before it applies.
We update the date at the top of this page whenever these terms change. If a change affects how orders, prices or the freshness replacement work, we will also say so on the call for any order already in progress. How cookies and personal data are handled is set out separately in the cookie notice and the privacy notice.
